This website is operated by Backery LLC. Throughout the site, the terms “we”, “us” and “our” refer to Backery. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

Accepting our terms and conditions and payment establishes a legally binding agreement between you and Backery.

All our Products made by us are subject to the following Terms and Conditions.

 

*Our Guarantee: Backery LLC will provide a professionally decorated dessert in a timely manner as specified in the invoice or contract.  We appreciate your business, and we are honored that you have chosen us for your special celebration. We guarantee that the flavors, size, and general design elements will be met as outlined. If you are not satisfied with our product(s) please let us know at the time you receive your order. Once your order is accepted, refunds will not be considered.

·      Order

We prefer at least fourteen (14) day notice for all orders, as we are continually booked in advance. We will however endeavor, where availability permits accept short notice cakes.

All custom decorated orders are to be paid 50% when the order is placed either by phone or in person at the bakery. Also, all online orders for pickup-drop off are paid in advance of 50% online when order is placed on www.backery.com. All deposits are non-refundable. There will be no credit given for orders cancelled inside of five (5) business days. For cancellations with more than five (5) business days’ notice, credit may be given for a future order.

Celebrations

Must be secured with a booking fee at least two weeks before the required collection or delivery date.  Sometimes our bakery can accommodate an order with shorter notice, so please get in touch with us to discuss your needs. A convenience fee will apply if Backery accepts your short notice.

·      Order Cancelations/Refund Policy

Backery understands that plans change, and we will gladly assist you in making changes to your order date and time whenever possible. We accept weekday cancellations by phone or email (customer@backery.com) 5 business days before your event. All changes must be handled directly with a representative of Backery and confirmed. Backery reserves the right to charge a cancellation fee if insufficient time is given, as stated above, due to costs incurred in the purchase, priority and preparation of the order. It is entirely up to Backery discretion, to change or otherwise offer any other options to the customer. Special orders (Highly Decorated Cakes) that are not picked up will NOT be refunded. Orders that require delivery and cannot be delivered due to customer’s wrong information or availability will be taken back to Backery and stored until further notice from customer. Should you require a future delivery date, you will be held responsible for an additional delivery charge. Because of the nature of our business and our quality and freshness assurance, we will dispose of any cake, cupcake, baked item that is not picked up or delivered within 48 hours after the due time and you will NOT be refunded due to the above rules.

*Where we cancel the booking due to illness or any other unforeseen circumstance that affects the ability to deliver the ordered Product, the deposit will be refunded within seven (7) days of notification to the Customer.

·      Change Order

There will be a $15 Change Order fee for any changes that are requested within 48 hours of the time required.

·      Delivery & Pick Up Terms

A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the product will be transported back with our premises, and it will be the customer’s responsibility to collect the product.

The balance is due on or before delivery/pickup date, and before the Product leaves the premises.

If paying by cash, correct change is appreciated, as we may not have the exact change on the premises.

If paying by internet transfer, the money needs to hit the account BEFORE the product leaves the premises.

Cakes may be setup 1-3 hours before your event. For outdoor events, we try to setup as close to the reception time as possible, which may limit design options. The Customer must disclose any adverse road hazards and/or obstacles that may hamper the delivery and quality of finished products. 

Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the cake as per our instructions. If anything is to happen to the cake after this exchange, we are not liable for any damages.

If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves the possession of Backery.

·      Design Variations

Although we make every attempt to provide an exact design and to match colors, custom cakes are a work of art. It may not be possible to match an exact shade of a color, but we will come as close as possible. The final product may be subject to slight variations.  Also be aware the exposure to light can cause colors to change. We do not offer discounts or refunds if the exact shade of a color is not achieved or if a variation occurs due to lighting.  If a major variation needs to be made Backery will communicate this to the customer and seek re-design approval.

·      Photographs & Marketing

We respect the privacy of all our clients. We will not disclose the identity of clients (photographs of people, last names, event details, contract details) without permission. We do however, reserve the right to photograph baked goods and use those photos on our website, social media, or marketing materials. We also reserve the right to use any photographs for display or promotion without compensation to you.

·      Allergy Disclaimer

Our bakery offers products that may contain: Peanuts, Tree Nuts, Soy, Dairy, Eggs, Corn and Wheat. While we take steps to minimize the risk of cross contamination (cleaning and sanitization and separating the prep, cooking and storage processes of baked goods made with these allergens), we cannot guarantee that any of our products are 100% safe to consume for people with peanut, tree nut, soy, milk, egg or wheat allergies.
